Evolution of intellectual property rights within the WTO: the TRIPS agreement

by Dr. Santanu Mukherjee, Advocate, certified Commercial Mediator, founder and Head of Ex Lege Chambers, WTI Alumnus

Global governance of Intellectual Property Rights (IPR) is addressed by the World Intellectual Property Organi-sation, the specialised agency of the United Nations, through a number of treaties administered by it. Inclu-sion of IPR within the WTO regime since 1995 has been a paradigm shift and has added a completely different dimension, often polarising position between industrialised and developing countries.

The lecture will present an overview of the evolution of IPR within the WTO with the TRIPS Agreement be-coming a foundational pillar of the WTO regulatory regime. It will discuss cases the key roles played by some of the developing country members of the WTO and how TRIPS impacted public policy making on IPR in the developing countries finally leading to the amendment of the TRIPS Agreement. The lecture help participants understand the historical background and provide a clear perspective on the ongoing IPR issues at the WTO.
